1. Introduction

Welcome to TheyWork. These Terms of Service ("Terms") govern your use of the TheyWork website (theywork.co) and AI Worker services ("Services") operated by TheyWork ("we", "us", or "our").

By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Services.

2. Definitions

"Account" means your registered account with TheyWork.

"AI Worker" means the artificial intelligence assistant provided through our Services.

"Content" means any text, data, files, messages, or other materials you submit to the Services.

"Organisation" means the company or entity associated with your Account.

"Services" means the TheyWork website, AI Workers, and all related features and functionality.

"Subscription" means a paid plan that provides access to the Services.

"User" means any individual who accesses or uses the Services.

3. Eligibility

To use TheyWork, you must:

  • Be at least 18 years old
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Services under applicable law
  • Provide accurate and complete registration information

If you are using the Services on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

4. Account Registration

4.1 Creating an Account

To access most features, you must create an Account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information as needed
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorised access
  • Accept responsibility for all activities under your Account

4.2 Account Security

You are responsible for maintaining the security of your Account. We are not liable for any loss or damage arising from your failure to protect your Account credentials.

5. Subscriptions and Payments

5.1 Plans and Pricing

TheyWork offers various subscription plans with different features and message limits. Current pricing is available at theywork.co/pricing.

5.2 Free Trial

We may offer a free trial period. At the end of the trial, you will be automatically charged for your selected plan unless you cancel before the trial ends.

5.3 Billing

  • Subscriptions are billed monthly in advance
  • Payment is processed through Stripe
  • All fees are in British Pounds (GBP) unless otherwise stated
  • Prices are exclusive of VAT where applicable

5.4 Message Limits and Credit Packs

  • Each plan includes a monthly message allowance
  • Additional messages can be purchased as credit packs
  • Credit packs do not expire
  • Unused monthly messages do not roll over

5.5 Cancellation

You may cancel your subscription at any time. Upon cancellation:

  • You will retain access until the end of your current billing period
  • No refunds are provided for partial months
  • Your AI Worker will be paused after the billing period ends
  • Your data will be retained for 30 days, then deleted

5.6 Refunds

We generally do not offer refunds. However, we may consider refund requests on a case-by-case basis. Contact us at hello@theywork.co.

5.7 Price Changes

We may change our prices at any time. Price changes will take effect at your next billing cycle. We will provide at least 30 days' notice of any price increase.

6. Acceptable Use

6.1 Permitted Use

You may use TheyWork for lawful business purposes in accordance with these Terms.

6.2 Prohibited Use

You agree NOT to use the Services to:

Illegal Activities

  • Violate any applicable law or regulation
  • Engage in fraud, money laundering, or other financial crimes
  • Infringe intellectual property rights
  • Harass, abuse, or harm others

Harmful Content

  • Generate or distribute malware or malicious code
  • Create content that is defamatory, obscene, or harmful
  • Produce content that exploits or harms minors
  • Generate spam or unsolicited communications

System Abuse

  • Attempt to gain unauthorised access to our systems
  • Interfere with or disrupt the Services
  • Circumvent usage limits or security measures
  • Reverse engineer or extract source code
  • Use automated tools to scrape or extract data

AI Misuse

  • Use AI Workers to impersonate real people without consent
  • Generate deliberately misleading or deceptive content
  • Create content designed to manipulate or deceive
  • Use the Services for political disinformation

6.3 Enforcement

We may suspend or terminate your Account if you violate these Terms. We reserve the right to remove any Content that violates these Terms.

7. Intellectual Property

7.1 Our Intellectual Property

TheyWork, including its design, features, and content, is owned by us and protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, or create derivative works from our Services without our written permission.

7.2 Your Content

You retain ownership of Content you submit to the Services. By submitting Content, you grant us a licence to:

  • Store, process, and display your Content to provide the Services
  • Use anonymised and aggregated data to improve our Services

7.3 AI-Generated Content

Content generated by AI Workers is provided for your use. You are responsible for:

  • Reviewing AI-generated content before use
  • Ensuring content complies with applicable laws
  • Any consequences of using AI-generated content

We do not claim ownership of AI-generated content, but we also make no guarantees about its accuracy, originality, or fitness for any purpose.

8. AI Worker Limitations

8.1 No Guarantee of Accuracy

AI Workers may produce inaccurate, incomplete, or inappropriate responses. You should:

  • Review all AI-generated content before use
  • Not rely solely on AI Workers for critical decisions
  • Verify important information independently

8.2 Not Professional Advice

AI Workers do not provide professional advice. Content generated should not be considered:

  • Legal advice
  • Financial or investment advice
  • Medical or health advice
  • Professional services of any kind

Always consult qualified professionals for such matters.

8.3 Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Services may be unavailable due to:

  • Maintenance and updates
  • Technical issues
  • Third-party service outages
  • Circumstances beyond our control

9. Data and Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your data.

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF CONTENT
  • UNINTERRUPTED OR ERROR-FREE SERVICE

12. Limitation of Liability

12.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

  • INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
  • LOSS OF PROFITS, REVENUE, OR DATA
  • BUSINESS INTERRUPTION
  • DAMAGES ARISING FROM USE OF AI-GENERATED CONTENT

12.2 Cap on Liability

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12.3 Exceptions

Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any liability that cannot be excluded by law

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

Nothing in these Terms creates a partnership, joint venture, or agency relationship between you and TheyWork.
